Gold Fever Luxe Lounge Terms and Conditions

These Terms and Conditions ("Terms") govern your participation in the Gold Fever Luxe Lounge ("Program"). By enrolling in or using the Program, you agree to be bound by these Terms. If you do not agree to these Terms, please do not participate in the Program.
1. Membership
1.1 Eligibility: The Program is open to legal residents of the United Kingdom who are 18 years of age or older. Membership is limited to one account per individual or business entity.
1.2 Enrolment: Enrolment in the Program is automatic and free of charge upon creating an account on goldfever.com and providing accurate and complete personal information. You are responsible for maintaining the accuracy of your account information.
1.3 Account Security: You are solely responsible for maintaining the confidentiality of your account login credentials and for all activity that occurs under your account. You agree to notify Gold Fever immediately of any unauthorised use of your account.
2. Program Structure
2.1 Levels: The Program features a tiered structure based on your total spending on eligible purchases at goldfever.com within a rolling three-month period, as follows:

2.2 Level Benefits: Each level offers specific benefits, including but not limited to discounts, exclusive promotions, and early access to sales. The benefits associated with each tier may vary and are subject to change at Gold Fever's discretion. The current level benefits can be found on https://goldfever.com/pages/loyalty-club.
2.3 Gold Fever Points:
- Earning Points: You earn 1 Gold Fever Point for every £33 spent on eligible purchases.
- Point Value: Each Gold Fever Point is worth £1.
- Unlimited Earning: You can earn unlimited Gold Fever Points at all tier levels.
- Redeeming Points: You can redeem your Gold Fever Points for discounts on future orders at any time.
- Saving Points: While you can redeem points at any time, we encourage you to save them for larger purchases, team use, or to showcase Gold Fever hair extensions to your clients.
- Points Expiration: Gold Fever Points expire after one year from the date they are earned.
2.4 Qualifying Period:
- Quarterly Assessment: Your purchases are assessed every quarter to determine your level status and Gold Fever Point earnings.
- Level Upgrade: When you unlock the next level, you will receive those privileges on your next order. The new level benefits will be valid for at least three months.
- Level Maintenance: To maintain your tier status, you must meet the spending requirement for that tier within each rolling three-month period.
- Quarters: The Program operates on the following quarterly schedule:
- October / November / December
- January / February / March
- April / May / June
- July / August / September
3. Program Benefits
3.1 Benefits: Program benefits may include, but are not limited to:
- Discounts on eligible purchases
- Exclusive promotions and offers
- Early access to sales and new products
- Free shipping on eligible orders
- Birthday rewards
3.2 Benefit Availability and Changes:
- Benefits are subject to availability and may vary by level.
- Gold Fever reserves the right to modify, suspend, or terminate any Program benefits at any time without prior notice.
4. Returns and Refunds
4.1 Impact on Tier Status: Returns and refunds will affect your tier status. The refunded amount will be deducted from your total spending, potentially resulting in a tier downgrade. Gold Fever Points earned from the refunded purchase will also be deducted.
4.2 Return Policy: Returns are subject to Gold Fever's standard return policy, which can be found on https://goldfever.com/policies/refund-policy.
5. Data Privacy
5.1 Personal Information: By participating in the Program, you consent to Gold Fever's collection, use, and disclosure of your personal information in accordance with our Privacy Policy, which can be found on https://goldfever.com/policies/privacy-policy.
5.2 Communication: A valid email address is required for Program communication, including notifications about your level status, exclusive offers, and Program updates.
6. Program Modifications and Termination
6.1 Program Changes: Gold Fever reserves the right to modify, suspend, or terminate the Program or any aspect thereof, including tier structure, benefits, Gold Fever Point system, and these Terms, at any time and for any reason, with or without notice.
6.2 Notice of Changes: Material changes to these Terms will be communicated to you via email or by posting a notice on the Gold Fever website. Your continued participation in the Program after such notice constitutes your acceptance of the modified Terms.
7. Opt-Out
7.1 Opting Out: You may opt out of the Program at any time by emailing hello@goldfever.com.
7.2 Effect of Opting Out: Upon opting out, you will no longer be eligible for Program benefits and your tier status will be forfeited. Any accumulated Gold Fever Points will be voided.
8. Limitation of Liability
8.1 Disclaimer of Liability: To the fullest extent permitted by law, Gold Fever and its affiliates, officers, directors, employees, and agents shall not be liable for any damages, losses, or expenses arising out of or in connection with your participation in the Program, including but not limited to any errors or omissions in the Program, any unauthorised access to or use of your account, or any other matters relating to the Program.
9. Governing Law and Dispute Resolution
9.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of England and Wales.
9.2 Dispute Resolution: Any dispute arising out of or relating to these Terms or your participation in the Program shall be settled by binding arbitration in accordance with the arbitration rules of the Chartered Institute of Arbitrators. The arbitration shall be conducted in London, England, and the language of the arbitration shall be English.
10. Entire Agreement
These Terms constitute the entire agreement between you and Gold Fever relating to the Program and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
